1. GENERAL TERMS OF SERVICE (TOS)

1. PARTIES This General Terms of Service agreement is executed between Alemdar Host Bilişim Teknolojileri - Nurullah BAYRAKTAR (hereinafter referred to as ALEMDAR HOST) and real or legal persons purchasing services/products via ALEMDAR HOST's website alemdarhost.com.tr (hereinafter referred to as the CUSTOMER).

2. SUBJECT OF THE AGREEMENT The subject of this agreement is to determine the rights and obligations of the parties in accordance with the Law No. 6502 on Consumer Protection, the Regulation on Distance Contracts, and the Internet Law No. 5651 regarding the sale, delivery, and use of web hosting, reseller hosting, domain names, VDS/VPS, dedicated servers, and additional services ordered electronically by the CUSTOMER from ALEMDAR HOST's website.

3. DELIVERY AND USE OF SERVICES

• Access credentials and passwords related to the ordered service will be sent to the CUSTOMER's registered e-mail address upon payment confirmation.

• The CUSTOMER accepts and undertakes to use the purchased service in accordance with the laws of the Republic of Turkey, general rules of ethics, and ALEMDAR HOST Terms of Use, and shall not host copyright-infringing, illegal, harmful content, or material causing SPAM e-mail generation or acting as a focal point for cyberattacks on the servers.

• Password and account security are entirely the responsibility of the CUSTOMER.

4. PAYMENT, RENEWAL, AND CANCELLATION

• Service fees are collected in advance. Services exceeding their due date are automatically suspended.

• Data belonging to unpaid and suspended services is retained for 10 (ten) days; if no payment is made by the end of this period, it will be permanently deleted from the system. ALEMDAR HOST cannot be held liable for data loss resulting from overdue payments.

CANCELLATION AND REFUND POLICY

• The CUSTOMER has the right of withdrawal without stating any reason within 14 (fourteen) days from the service start date for purchased Web Hosting and Reseller Hosting services.

• Domain name registration/transfer transactions, VDS/VPS virtual servers, dedicated servers, SSL certificates, and custom software/licensing services are excluded from the refund scope.

6. LIMITATION OF LIABILITY ALEMDAR HOST cannot be held directly responsible for interruptions caused by data centers, Türk Telekom / service provider infrastructure failures, line disruptions, CUSTOMER software errors, or force majeure events. The CUSTOMER is responsible for maintaining routine backups of their own data.

7. JURISDICTION AND AUTHORIZED COURTS The Courts and Enforcement Offices of Istanbul (Anadolu) shall have jurisdiction in resolving any disputes arising from the implementation of this agreement.

2. PRIVACY AND PERSONAL DATA PROTECTION POLICY

1. DATA CONTROLLER In accordance with the Law No. 6698 on the Protection of Personal Data ("KVKK"), your personal data is processed by Alemdar Host Bilişim Teknolojileri - Nurullah BAYRAKTAR in the capacity of data controller within the scope explained below.

2. COLLECTED DATA AND PURPOSES OF PROCESSING Personal data collected during registration and ordering processes—including Name, Surname, T.C. ID Number / Tax Number, Address, Phone Number, E-mail, and IP access logs—are processed for the following purposes:

• Issuing invoices and fulfilling legal obligations,

• Providing services technically and managing customer support processes,

• Keeping access records (logs) as required by Law No. 5651.

3. PAYMENT AND FINANCIAL SECURITY Credit card details belonging to the CUSTOMER are strictly NOT stored on ALEMDAR HOST servers. Payments are processed directly through licensed payment institutions and banks equipped with SSL/TLS security certificates and 3D Secure protection.

4. TRANSFER OF DATA Your personal data is never sold or rented to third parties for commercial purposes. However, due to legal requirements, it may be transferred to official requests from authorized public institutions such as Courts, Prosecutor's Offices, Law Enforcement, and BTK (Information and Communication Technologies Authority), as well as to domain registry authorities (TRABİS, ICANN, etc.) mandatory for domain registration.

5. YOUR RIGHTS UNDER KVKK Pursuant to Article 11 of the KVKK, the CUSTOMER has the right to learn whether their personal data is processed, to request correction of inaccurate data, and to request the deletion or anonymization of data outside mandatory legal retention periods.
